*Please be aware that Reef Tax is a government charge that can be altered at any time without notice.

*Security Bonds are required upon check in for hire of snorkel equipment and stinger suit hire. Cash deposits or credit card details on file are both accepted

*$10 key deposits are required upon check in for accommodation at Koala Adventure Resort.

 

Koala Adventure Island Pty Ltd – Whitsunday Sailing Terms & Conditions

 

A cancellation fee applies to all travel.

Travel Voucher valid for 12 months from date of purchase.

Koala Adventure Island (the ‘Company’) acts only as an agent for hotels, hostels, airlines, adventure tour companies, insurance companies, and other providers of travel and related services to the Traveller (the ‘Supplier’). As such, and while the Company makes efforts to ensure that the quality of the services rendered by the suppliers is consistent with the description provided, the pictures, photographs and descriptions included in any printed material or online do not constitute any form of representation, warranty or guarantee that all of the attributes will be as depicted.

POSTPONEMENT/TRANSFER

All coupons, exchange orders, receipts, contracts and tickets (the ‘Travel Documents’) are issued subject to any and all tariffs, terms and conditions under which such services are provided by the Suppliers.

The Customer’s acceptance and use of such travel Documents shall also evidence the Customer’s consent to these conditions.

The Company, its affiliates, agents and employees assumes no responsibility and shall not be liable for any loss, damage or other claim, whether to person or property, that does not arise directly as a result of negligence of the Company its affiliates, agents or employees in facilitating the Customer’s purchase of Supplier(s) services. Travel insurance is highly recommended.

LIABILITY

Please note that we refuse the right of boarding to any guest who arrives intoxicated by alcohol or under the influence of illegal substances.  If this occurs, we will not refund any monies paid.

Guest should note that Koala Adventure Island (the ‘Company’) while our crew will make every effort to ensure guest safety; we cannot be accountable for actions of guests that are beyond our control.  If any guest causes a disturbance or threatens the safety and comfort of other guests or crew, they will be warned and if the behaviour continues, possibly removed from the vessel. This removal will be at the guest’s expense.

Koala Adventure Island (the ‘Company’) has the applicable Shipowners insurance to cover public liability for our guests and staff.

CANCELLATIONS

The Customer expressly acknowledges that, in the event any service provided by a Supplier could become unavailable due to circumstances beyond the Company’s control, the Company shall, at the Company’s sole discretion and without prior notice to the Customer, be entitled to substitute services of equal or greater value without refund to the Customer, and such substitution shall be deemed to be complete compensation such that the customer shall have no further claim against the Company.

In cases were rescheduling is deemed  necessary and beyond Koala Adventure Island control customer’s will be offered the next available departure and such substitution shall be deemed to be complete compensation such that the customer shall have no further claim against the company.

Between 14 days to 72 hours of departure, Loss of 50% of Ticket Price.

72 hours before departure will result in forfeit of full trip fees.

Please note Reef taxes are not refundable.

WEATHER CONDITIONS

Under no circumstances can Koala Adventure Island be held responsible for weather conditions, nor can any holiday be cancelled or amended by you at any time on the basis of weather conditions.  Under no circumstances will refunds be given due to weather.

ITINERARIES

Please note that tour itineraries are flexible and that the Captain and Crew will do their best to visit the iconic features of the Whitsunday’s.  It is important to be aware, that in the event of strong winds or storm, locations listed in itineraries may not be visited.  Further, it may be necessary to use the boat’s engine to make it to the iconic features around the islands, particularly in instances where tidal floods or ebbs are strong.  The safety and well being of guests, crew and the vessel is paramount and the captain’s discretion and professional judgement is final. 

INSURANCE

It is strongly recommended that you take out comprehensive insurance cover for any cancellation, medical expenses, personal accident, personal baggage, money and public liability prior to arrival at your destination.  You agree to indemnify us against all third party claims, actions, damages and remedies.  We strongly recommend that guests take out their own travel insurance to cover valuable items, eg. Cameras, and to protect themselves against unforseen last minute cancellations or medical conditions that may occur during carriage, and the associated extra costs of accessing medical care around the islands.

COMPLAINT

Should you have a complaint, you should inform Koala Adventure Island during the course of the vacation and if the matter cannot be resolved after the Representative best endeavour to do so during the holiday, your complaint should be made in writing to Koala Adventure Island as soon as is possible after the holiday but within 28 days thereof so that your complaint can be investigated.  Any claims made after the 28 day period will be considered by Koala Adventure Island.  If you choose to write to Koala Adventure Island via the internet, please provide your home address so that we are able to reply to you in writing.

Koala Adventure Island is committed to protecting your privacy. This statement discloses the practices by which Koala Adventure Island intends to protect the quality and integrity of your personally identifiable information.

We understand how important the privacy of your personal information is to you, as such, Koala Adventure Island provides the following guidelines defining how we shall deal with your personal information:

COLLECTION
Koala Adventure Island will only collect personal information that is necessary for providing those services offered on our website. We shall advise you at all times the purpose of our collection and ensure that your personal information is collected by lawful and fair means and by your express consent.

When submitting information on our site, we will collect details including your name and email address such that newsletters can be delivered to you. The information we collect is essential for us to be able to identify accurately who is requesting our newsletter service so that we may be able to respond to your request.

Such information which is collected will be held in the strictest confidence.

USE & DISCLOSURE
Personal Information we collect will only be used and disclosed for the purposes identified in our website. Should Koala Adventure Island intend utilising this information for secondary purposes your express consent would first be obtained.

DATA SECURITY
In house safeguards will monitor and maintain personal information to protect against unauthorised access, misuse, alteration, destruction and loss. Furthermore, all information that Koala Adventure Island no longer requires will be destroyed or permanently de-identified to ensure continued protection of your personally identifiable information.

DATA QUALITY
Reasonable steps will be taken to ensure that personal information which is collected, used and disclosed is relevant, accurate, complete and up to date for the purposes for which it is to be utilised.

IDENTIFIERS
Koala Adventure Island will not adopt an identifier that has been assigned by a Government agency as a means of identifying an individual.

ACCESS & CORRECTION
Where information is held by Koala Adventure Island regarding an individual, access will be provided upon request in a form reasonably suitable to the information held, except to the extent that;

(a) The request for access by the individual is frivolous or vexatious; or
(b) Providing access would unreasonably impact on the privacy of others; or
(c) Providing access would be unlawful; or
(d) Providing access would prejudice commercial negotiations between the individual and Adventure Island

If access is denied to an individual then written reasons will be provided outlining why access has been denied.

Where an individual establishes that the information held about them by Koala Adventure Island is not accurate, complete or up to date, Koala Adventure Island will take reasonable steps to correct that information.

We will provide full access to all personal information you have given to us. If you do not wish to have personal information used for a particular purpose we will not do this.

ANONYMITY
Whenever it is lawful and practicable, individuals will have the option of not identifying themselves when entering into transactions with Koala Adventure Island.

Koala Adventure Island publicly exhibits its personal information practices and management policies. As well as making these guidelines available Koala Adventure Island will take reasonable steps to bring to your attention what information it holds, for what purposes and how it collected, uses and discloses that information.

TRANSBORDER DATA FLOWS
Koala Adventure Island will not transfer personal data outside of Australia unless:

(a) the individual concerned consents to the transfer; or
(b) Koala Adventure Island has a reasonable belief that the overseas recipient is subject to similar privacy laws to Australia
(c) the transfer is necessary for the performance of a contract between the individual concerned and Koala Adventure Island
(d) the transfer is for the benefit of the individual concerned and it is not practicable to obtain the individual's consent as to the subject matter of the information transferred.

SENSITIVE INFORMATION
Koala Adventure Island will not collect personal information which reveals race, religious beliefs, political opinions, trade union membership, details of health, disability or sexual activity or orientation unless the individual has consented.

As such Koala Adventure Island will not collect personally identifiable information about you except when you have authorised us to do so.

COOKIES & BROWSING

Information we collect via our website contributes to the development of the site by allowing statistical analysis of users. This collection of statistical data is carried out anonymously with no attempt to identify users or monitor their specific browsing activities.

As such, in order to help us improve our customer service, we utilise cookies in order to statistically track our web sites performance. We collect anonymous information from users of our web site including monitoring the domains from which people visit and measuring visitor activity.

We will only use your disclosed personal information or information generated by cookies that you have provided to us when we have given you notification of the intended use or disclosure and you have not objected to that use or disclosure or you have specifically and knowingly provided that information to us.
